These Terms govern your access to and use of PeakSync, operated by PeakSync.net.

These Terms of Service (“Terms”) govern your access to and use of PeakSync, a software service operated by PeakSync.net (“PeakSync,” “we,” “us,” or “our”).
1. Agreement and eligibility
By creating an account, purchasing a paid service, or using PeakSync, you agree to these Terms.
You must have the legal capacity to enter into this agreement where you live. PeakSync is not intended for children.
2. Age Requirement
You must be at least 18 years old to use this Service. The Service involves control of an adult device. By using the Service, you confirm that you meet this age requirement.
3. The service
PeakSync provides software tools for analyzing motion in video and generating timestamped motion-position data. Generated motion data can be edited in PeakSync, exported as Funscript (.funscript) or CSV files, played back in sync with media, and used with compatible third-party devices and services.
PeakSync does not provide a public source-video library or user-to-user source-media publishing service.
We may add, modify, suspend, or discontinue features for operational, technical, security, or legal reasons.
4. Accounts
You must provide accurate account information and keep your account credentials secure.
You are responsible for activity performed through your account and must notify us promptly if you believe your account has been accessed without authorization.
You may not access or use another person's account without permission.
5. Your sources and scripts
You retain the rights you have in videos, scripts, and other materials you provide to PeakSync.
You authorize PeakSync to process submitted materials as necessary to provide, secure, and support the services you request, subject to our Privacy Policy.
You are responsible for ensuring that you have the rights, permissions, and lawful basis necessary to process any material you submit.
PeakSync may reject, stop, or remove processing that violates these Terms or applicable law.
6. Prohibited use
You must not use PeakSync to:
- process content involving unlawful exploitation or abuse, including child sexual abuse material or non-consensual intimate imagery;
- infringe another person's privacy, copyright, publicity, or other legal rights;
- bypass digital rights management (DRM), paywalls, authentication, or other technical access controls;
- distribute malware, disrupt or interfere with the service, bypass security controls, or gain unauthorized access to accounts, systems, data, or credentials;
- use connected devices without the required authorization or consent, or in a manner that endangers people or property; or
- engage in or facilitate any activity prohibited by applicable law.
We may take appropriate action, including restricting or suspending access to the service, where we reasonably believe these rules have been violated.
7. Generated data and third-party integrations
Motion analysis results, including generated scripts and other motion data, may contain errors, omissions, or timing inaccuracies and may not be suitable for every source or intended use. You should review generated data and make any necessary adjustments before use. When using connected devices, check compatibility and select appropriate operating settings.
Some features allow you to connect PeakSync with supported third-party devices, software, or services. Your use of those products and services is subject to the relevant provider's terms and privacy policies, where applicable. Any warranties offered by those providers are governed by their own warranty terms. Changes to third-party software, firmware, or services may affect the availability or compatibility of these integrations.
PeakSync does not manufacture third-party hardware. You must follow the manufacturer's instructions and operating limits when using connected devices, and stop use if a device behaves unexpectedly or presents a safety risk.
8. Payments, subscriptions, and credits
PeakSync may offer paid subscriptions, one-time Credit purchases, and promotional Credits. The applicable price, currency, billing period, included Credits, and any rollover, expiration, or promotional terms will be shown before you complete a purchase.
8.1 Subscriptions
Paid subscriptions renew automatically at the end of each billing period unless you cancel before the next renewal.
By purchasing a subscription, you authorize PeakSync or its payment provider to charge the applicable recurring subscription fee to your selected payment method.
You may cancel your subscription through the cancellation method provided by PeakSync. Cancellation stops future renewals and takes effect at the end of your current paid billing period. You will continue to have access to the applicable subscription benefits until that period ends.
If the price of a subscription changes, the new price will apply only to a future renewal after any notice required by applicable law.
8.2 Credits
Credits are used to access eligible generation features.
For standard video generation, 1 Credit currently corresponds to 1 minute of video processed for generation. If a feature uses a different Credit rate, the applicable rate will be shown before you submit the task.
Subscription Credits are provided according to your selected plan. Any rollover limit or expiration rule for subscription Credits will be disclosed as part of the applicable plan.
Unless otherwise stated at purchase, separately purchased Credits remain available in your account independently of your subscription and are not lost merely because you cancel a subscription.
Credits have no cash value, cannot be redeemed for cash, and may not be transferred or resold unless PeakSync expressly allows it.
8.3 Credit deductions and failed tasks
The Credit cost of a generation task will be shown or calculated based on the video duration and applicable generation rate.
If a generation task fails because of a technical error on PeakSync's side and no usable result is produced, Credits charged for the failed processing will be restored to your account.
A completed generation is not considered a technical failure solely because the generated data requires editing or does not meet a user's subjective expectations.
If you cancel a task before processing begins, no Credits will be charged. Once processing has begun, Credits already used for processing may not be restored unless the failure is attributable to PeakSync or applicable law requires otherwise.
8.4 Promotional and free Credits
Free, bonus, trial, or promotional Credits may be subject to separate limits, expiration dates, eligibility requirements, or promotional terms disclosed when they are issued.
Promotional Credits cannot be exchanged for cash or refunded. PeakSync may remove promotional Credits obtained through fraud, duplicate accounts, abuse, or violation of these Terms.
8.5 Refunds
Cancellation of a subscription does not normally refund charges already incurred and does not create a right to a partial refund for the remaining billing period.
Used Credits are generally non-refundable. Refunds for unused purchases, subscription charges, or other payments will be handled in accordance with the refund terms presented at purchase and any rights provided by applicable law.
Nothing in these Terms limits any mandatory refund, withdrawal, cancellation, or other consumer rights that cannot lawfully be excluded.
8.6 Payment processing, taxes, and reversed payments
Payments are processed by third-party payment providers and may also be subject to their applicable terms and privacy policies.
Applicable taxes or similar charges may be added or collected where required by law and will be shown where applicable during checkout.
If a payment is refunded, reversed, charged back, or otherwise cancelled, Credits or subscription benefits associated with that payment may also be removed. If Credits associated with the reversed payment have already been used, PeakSync may restrict further paid generation until the payment issue is resolved.
8.7 Changes to plans and Credit rates
PeakSync may introduce, modify, or discontinue subscription plans, Credit packages, promotional offers, or Credit rates.
Changes will not retroactively alter Credits that you have already purchased. Changes to recurring subscription pricing or material subscription terms will apply to future billing periods and will be communicated in advance where required by applicable law.
9. Suspension and account deletion
You may stop using PeakSync or request deletion of your account at any time.
We may restrict or suspend access where reasonably necessary to address:
- violations of these Terms;
- unlawful activity;
- fraud or payment abuse;
- security or device-safety risks; or
- legal or regulatory requirements.
If you believe your account was restricted in error, you may contact us.
Personal information associated with account closure is handled in accordance with our Privacy Policy and applicable law.
10. Availability and disclaimers
To the extent permitted by law, PeakSync is provided “as is” and “as available.”
We do not guarantee that the service will always be uninterrupted or error-free, or that generated results or third-party integrations will always be accurate, compatible, or available.
You are responsible for the materials you choose to process, your use of generated data, and your configuration and use of third-party devices.
Nothing in these Terms excludes or limits any right, remedy, or responsibility that cannot legally be excluded or limited.
11. Changes
We may update these Terms to reflect changes to the service, law, security requirements, or our business practices.
If a change materially affects your rights or obligations, we will provide additional notice or request renewed acceptance where required by applicable law.
The effective date shown above indicates when these Terms were last updated.
